Safer ELD reserves the right to update or modify these Terms & Conditions at any time for any reason. The version currently posted on the Safer ELD website supersedes all previous versions. Users are encouraged to review these Terms periodically to stay informed of their obligations.

Safer ELD may collect personal information including, but not limited to, name, email address, date of birth, tax identification number, billing and shipping addresses, phone number, payment information, and other account-related data. Protecting your privacy is important to Safer ELD. Please review the Privacy Policy to understand how information is collected, used, disclosed, and protected, and your responsibilities as a user of the Products.

Safer ELD is committed to protecting the personal information you share. You are responsible for maintaining the confidentiality of your login credentials and for keeping your contact information up to date. Safer ELD will never request your password but may request limited information to verify your identity.

Safer ELD offers various hardware devices (“Devices”). All Devices are subject to these Terms and any device-specific terms. Safer ELD reserves the right to modify, suspend, or discontinue any Device at any time and may require customers to enter into a minimum-term agreement to maintain access.

Most Products require an upfront hardware purchase along with a monthly, quarterly, or annual subscription. Subscription fees are billed in advance unless otherwise stated.

You are solely responsible for safe driving and compliance with all traffic laws. Devices must not be used while driving. Safer ELD is not responsible for damages caused by unsafe driving behavior.

Safer ELD offers a 30-day no-questions-asked refund policy applicable to both hardware and subscription services.

• Refund requests must be submitted within 30 days from the date of purchase.
• After 30 days, no refunds will be issued for hardware or subscription fees.
• Returned hardware must be in original condition and original packaging.
• Customers are responsible for all return shipping, insurance, and any damage during transit.
• Safer ELD reserves the right to charge a restocking fee where applicable.

Subscriptions are billed in advance and automatically renew unless canceled in writing at least 7 days prior to the renewal date. After the 30-day refund period, subscription fees are non-refundable. Subscription terms cannot be modified during an active subscription period.

All purchases made through the Safer ELD website, customer support, or other channels are governed by these Terms. Orders constitute an offer to purchase, which Safer ELD may accept or decline at its discretion. Users warrant that payment information provided is accurate and authorized.

Safer ELD warrants that hardware will be free from defects in materials and workmanship during the applicable warranty period. If a defect occurs, Safer ELD may repair, replace, or refund the depreciated value of the hardware at its discretion.

Customers are responsible for returning defective devices within the required timeframe. Failure to do so may result in replacement or non-return fees.

Safer ELD Products are intended for use where legally permitted. Users accessing the Products from outside supported regions are responsible for compliance with local laws and regulations.

You agree to indemnify and hold harmless Safer ELD, its officers, employees, and partners from any claims, damages, losses, or expenses arising from misuse of Products, violation of these Terms, or violation of applicable laws.

All software, content, and materials provided by Safer ELD are protected intellectual property. Users are granted a limited, non-transferable license for lawful use only. Unauthorized copying, resale, reverse engineering, or exploitation is strictly prohibited.

“Safer ELD” and all related names, logos, and marks are trademarks of Safer ELD. Written permission is required for any use.

All Products are provided “as is” without warranties of any kind. To the maximum extent permitted by law, Safer ELD shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Products.

All disputes must be brought on an individual basis. Class actions, collective actions, or representative claims are not permitted.

At Safer ELD’s discretion, disputes may be resolved through binding arbitration under applicable arbitration rules.

These Terms are governed by the laws applicable to Safer ELD’s principal place of business.
